Off the Couch Kids may modify, suspend, discontinue or expand the extent of the services provided on this site at any time in its absolute discretion. By continuing, you acknowledge that you have read and understood the Terms & Conditions.  By making a purchase from this website you agree to be bound by the Terms & Conditions. Off the Couch Kids cannot guarantee that it will be able to prevent, or notice, illegal or inappropriate use of this website.  The products and services on this website are not available to anyone under 18 years of age.  The products are only available for sale to people who can make legally binding contracts.

The Internet is a hostile environment with global resources.  Off the Couch Kids maintains highly regulated security policies and procedures to all external and internal communications of Off the Couch Kids. Orders

Any order placed by you in the manner described in this website is an offer by you to purchase a particular product for the price (including the delivery and other charges) specified in this website at the time you place your order on these Terms and Conditions. Off the Couch Kids reserves the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order.

The prices of products, services, delivery and any other charges are current at the time of issue, but are subject to availability and also may change at any time.  Also the availability of services and products may change.

Risk

Off the Couch Kids will retain title to the products you order until payment has been made in full for the products, but all risk in the products will pass to you upon dispatch from our distribution centre.  You should consider obtaining any suitable insurance.

Limitation of Liability

You agree and understand to indemnify and hold Off the Couch Kids, its employees and agents of each harmless for all liabilities.  Off the Couch Kids is not liable for any damages, costs and expenses, economic loss or other loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. 

Shipping and Delivery

We endeavor to ensure that all orders are dispatched by us within 1 to 2 working days upon receipt of order.  Working days exclude Saturdays, Sundays and Public Holidays.  Generally delivery takes 3-5 working days, after dispatch from us, to anywhere in Australia.  We are located in Melbourne Victoria and delivery to remote areas in Australia could possibly take longer than the time stated.

Packaging

We reuse boxes and packaging wherever possible in order to help the environment.  You may receive your order in recycled packaging.

Payments

All payments are only accepted in Australian dollars.  Payments in any other currency with not be accepted.

Payment Methods

Payments are made through the auspices of Paypal.  Paypal offer payment by Visa and Mastercard.

At no time will Off the Couch Kids except payment over the telephone, by cheque, money order or cash.

PRICING

The prices that appear on this web site are quoted in Australian Dollars (AUD) and are valid in Australia only. All prices quoted are inclusive of 10% GST unless otherwise stated.  Please note that prices are subject to change without notice, Off the Couch Kids  reserves the right to adjust information or pricing due to typographical errors, market fluctuations and/or manufacturers price changes.  Off the Couch Kids takes no responsibility or liability for the accuracy of any such price as it applies to any particular purchase. 

Statutory Conditions and Warranties

While Off the Couch Kids makes every effort to deliver the highest quality, there are times when things don’t go according to plan.  Customers can be assured that Off the Couch Kids abides by all Australian laws relating to consumers as laid out in the Fair Trading Act 1999 & Trade Practices Act 1974. Nothing in these Terms and Conditions excludes the application of all statutory conditions and warranties.

Returns

We are sure that you will be delighted with your order from Off the Couch Kids.  If for any reason you change your mind or if what you purchased from us is not what you expected, we will offer you a credit note, exchange or refund to the value of the product. In all instances, shipping costs are non-redeemable and refunds will only be for the cost of the product(s) purchased. You must contact Off the Couch Kids to get an authorization number, before returns will be accepted.

Off the Couch Kids will not provide a refund, give credit for, or replace a product that has been misused, mishandled or incorrectly installed or serviced. It is the responsibility of the customer to ensure that all instructions and advice or warnings given by the manufacturer or supplier are followed.

Change of mind returns will only be considered if Off the Couch Kids is notified within 7 days of your receipt of your order. The goods must then be returned to Off the Couch Kids in saleable condition (in their original condition, unopened and in the original packaging with all product tags and labels still attached to the product). The product must be received by Off the Couch Kids before any refund, replacement or credit is given.

Faulty Products. Purchases can be returned for a full refund or replacement if faulty.  Please allow 14 days from the date we receive the returned goods for your return and refund request to be processed.
